After the Supreme Court lifted a ban on sports betting, states began regulating the industry. Some started with retail sportsbooks, while others launched online offerings.
Ohio was a latecomer to legal sports betting, but it launched Jan. 1, 2023, and now ranks among the top five markets in the country.
New Jersey
New Jersey was one of the first states to offer legal sports betting after the Supreme Court ruled that individual states had the right to regulate the activity. The Garden State is home to several popular sportsbooks, including BetMGM, DraftKings, FanDuel, and PointsBet. Each offers competitive lines, promotions and features for New Jersey bettors.
In 2022, New Jersey topped the US market in retail sportsbook handle and became the third-largest online sportsbook state by revenue. In addition to a wide range of sports events, New Jersey bettors can find the latest lines for horse races and boxing fights. Moreover, bettors can choose between numerous payment methods, including casino cage cash, prepaid cards and PayPal. ACH/e-check withdrawals are also available but may take up to five business days. Pennsylvania
The state of Pennsylvania is one of the first to allow sports betting after the US Supreme Court struck down PASPA. The industry launched in November 2018 at retail venues, and online in May 2019.
Legal sports betting is available to anyone 21 years of age or older in the Keystone State. Wagering on major sports like NFL, NBA, and NHL is supported by a wide variety of betting lines. In addition, college sports can be wagered on as well.
The state’s major teams boast some of the biggest rivalries in all of professional sport. The Philadelphia Phillies and Pittsburgh Pirates have two of the most storied histories in MLB, while the Pittsburgh Penguins have won five Stanley Cup championships. There is also a plethora of world-class NCAA Division 1 programs. The Pennsylvania Gaming Control Board oversees the industry and offers consumer protections.
Maine
Known as Vacationland, Maine’s small towns, beaches, harbors and islands make it an ideal place to kick back and relax. It has also been known for its burgeoning food scene. But a few years ago, there was little reason for anyone in the state to wager on sports.
In 2022, sports betting became legal thanks to a bill called LD 585. It passed both houses of the legislature and went to the Governor’s office for a final signature. However, due to a quirk in Maine law, the Governor didn’t sign it.
The bill allows each of the state’s four federally recognized Indian tribes (Penobscot, Passamaquoddy, Micmac and Maliseet) to pair up with a commercial sportsbook provider. That process should begin sometime in late 2022. When that happens, Maine will finally join the ranks of states with online sports betting.
New Mexico
New Mexico residents can place sports wagers at Santa Ana Star Casino and the Buffalo Thunder Casino in Bernalillo, thanks to a partnership with USBookmaking. Unlike other states, however, these retail sportsbooks don’t offer online betting options. This means bettors can’t shop around for the best odds and must accept the lines set by each physical book.
Despite having no major professional sports teams that call the state home, New Mexico boasts a robust fanbase for college athletics. The burgeoning market could create a decent amount of sports betting handle for the state if lawmakers ever legalize the practice. State law currently prohibits betting on in-state collegiate teams, and player prop bets are prohibited as well. The Land of Enchantment is also close to Colorado and Texas, which both have thriving sports betting markets. Those areas could serve as models for the state’s future.
Tennessee
The state of Tennessee made sports betting legal in 2021, just six months after the Supreme Court ruled against PASPA. Retail and online/mobile sports wagering are now available in the state, though betting on in-state collegiate games and player props remain prohibited.
TN sportsbooks can take bets on all major team sports, including the University of Tennessee Volunteers and the Memphis Grizzlies. The most popular bet type is on professional football, with the Titans a perennial contender in the AFC South.
The state’s sports betting laws are a bit more restrictive than many other states, with the 90% payout cap a significant deterrent for some bettors. This could lead to some fans travelling to bordering bettor-friendly states like West Virginia, Arkansas and Mississippi to find better odds. The state lottery will revisit its rules and regulations in a year to determine whether they should be amended.
Delaware
With PASPA repealed, Delaware wasted no time in becoming one of the first states to legalize sports betting. The state has had a limited form of sports betting available through its lottery since 2018. Its three land casinos now allow sports bets to be placed.
The state is now looking at a future where online betting is added to the mix. It could be that the lottery will create its own sports betting platform, or it might partner with one of the major operators already in the market.
While there are no major professional sports teams in the state, fans of these teams still have a strong presence in Delaware. These fans may be able to claim the same bonuses and promotions offered in other legal markets. These include free bets that don’t require depositing real money.
Maryland
The Old Line State became the latest to launch legal sports betting this week, four years after the Supreme Court lifted the federal ban on gambling on sports. Maryland’s legal sports betting market is a bit smaller than other states, but it should still have plenty to offer bettors.
The Maryland law will eventually allow for up to 60 online sportsbook skins, plus in-stadium wagering at three pro sports stadiums (Baltimore Ravens, Baltimore Orioles and Washington Football Team), two thoroughbred race tracks, the state fairgrounds, and certain off-track betting facilities. The law also includes a provision to encourage inclusivity by requiring that at least one licensed operator set goals for hiring minority- and women-owned companies as subcontractors.
In-person betting is currently legal at the state’s six casinos, and in the professional sports stadiums of the Baltimore Ravens, Orioles and Washington football teams. The first online sportsbook in Maryland is expected to be launched by Bally Bet and WynnBET, both of which have applied for a license with SWARC.
Massachusetts
The state of Massachusetts has now legalized sports betting after years of debate. In the final moments of the legislative session, lawmakers reached a compromise and passed bill H5164. The law will make sports betting legal in the state both online and in person.
The bill includes a 20% tax on wagers, which should benefit both bettors and the state coffers. It also allows the state to license seven online-only sportsbooks and two mobile betting apps. Its retail casinos and racetracks will get two licenses each, while the in-state raceways will be allowed one each.
A minimum age of 21 will be enforced for sports betting, and bettor must be physically within the state boundaries to place a wager. The law will also ban credit cards, which are popular sports betting deposit methods in most states.
Nebraska
Nebraska voters approved sports betting in November 2021, but it has taken a while for the state to launch. The state’s legal status as a sports betting market is retail-only and it doesn’t include mobile wagering.
There are no professional sports teams based in Nebraska, so loyalty to pro sports teams tends to focus on teams from neighboring states. Among NFL fans, the Kansas City Chiefs and Denver Broncos are popular choices, while Nebraskans also root for the Chicago Bears and Colorado Rockies in MLB.
Interested Nebraskans can visit WarHorse Casino to place in-person sports bets. Online betting isn’t yet available, but daily fantasy sports sites like DraftKings and FanDuel accept paid entries from residents of the state and are often quick to introduce their services in states where sports betting is legal.
North Dakota
North Dakota’s gambling laws do not mention online sports betting, but a bill that would have legalized it in the state was killed by legislators in 2022. The legislation was stalled by concerns over college sports betting, which is not allowed under state law.
The state does not yet offer any online or in-person sports betting, but ND residents can wager on professional teams outside of the state. In addition, offshore sportsbooks that are licensed to operate in the US and don’t violate ND gambling laws can accept wagers from state residents.
Those who are interested in placing bets on their favorite team can find plenty of options at one of the state’s three tribal casinos. Currently, ND residents can place bets on professional teams from the NFL, NHL, and MLS. They also have the MLB’s Minnesota Twins to root for, which could be a popular choice among ND sports fans when sports betting becomes legal in the state.
